Terms of Service

1. Acceptance of Terms
By accessing and using the EIM platform and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
EIM Incorporated ("EIM", "we", "our") reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
EIM provides a cloud-based software platform for upstream oil and gas well management, including but not limited to well planning, data management, field operations monitoring, reporting, and artificial intelligence analytics.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify EIM immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service in violation of any applicable law or regulation
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you input into the Service. EIM will not share your data with third parties except as described in our Privacy Policy.
6. Intellectual Property
The Service, including all software, content, trademarks, and documentation, is the property of EIM Incorporated and is protected by applicable intellectual property laws. These Terms do not grant you any rights to EIM's intellectual property except as expressly stated.
7. Payment Terms
If you subscribe to a paid plan, you agree to pay all fees associated with your selected plan. Fees are non-refundable except as required by law or as otherwise stated in your subscription agreement.
8. Limitation of Liability
To the maximum extent permitted by law, EIM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. EIM's total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
9. Termination
Either party may terminate these Terms at any time. Upon termination, your right to use the Service ceases immediately. EIM may retain your data for a reasonable period to facilitate data export, after which it will be securely deleted.
10. Governing Law
These Terms are governed by the laws of the Province of Alberta, Canada. Any disputes arising from these Terms shall be resolved in the courts of Alberta.
